National Vaccine Injury Compensation Program (VICP).

WHAT IS THE VACCINE INJURY COMPENSATION PROGRAM?

The National Vaccine Injury Compensation Program (NVICP) was created by Congress in 1986 as a no-fault alternative to the traditional civil lawsuit where the injured person sues the doctor or vaccine manufacturer. Unlike the traditional civil lawsuit, in the Vaccine Program the injured party bringing the claim (the “petitioner”) files a Petition along with an Affidavit describing his or her injury and medical records documenting his or her alleged injury. 

HOW MUCH WILL A VACCINE LAWYER COST?

ABSOLUTELY NO LEGAL FEES. 
All attorney’s fees, costs and expenses are paid by the vaccine trust fund to the attorney. Following the conclusion of your claim, the attorney separately files a motion to the Vaccine Court for all fees, costs, and expenses and is paid from the vaccine trust fund.  The injured party keeps 100% of the awarded compensation.

HOW DOES THE VACCINE INJURY COMPENSATION PROGRAM WORK?

The VICP created the Vaccine Injury Compensation Trust Fund to compensate those who suffer from vaccine related injuries.  An excise tax of $.75 is placed on each illness that is prevented by the vaccination that is administered in the United States and those monies are placed into the Vaccine Injury Compensation Trust Fund to compensate injured parties. The vaccine trust fund presently holds over $3 billion.

WHAT VACCINES ARE COVERED BY THE VACCINE PROGRAM?

The Vaccine Injury Compensation Program covers most routine vaccinations including:
  • Diphtheria, Tetanus, Pertussis, Tetanus Toxoid, or any combination of Diphtheria, Tetanus, Tetanus Toxoid, and Pertussis (such as “DT,” “DTaP,” “Tdap, “TT,” “Td,” and “DTP” vaccines)
  • Haemophilus influenzae type b (such as Hib)
  • Hepatitis A
  • Hepatitis B
  • Human Papillomavirus (such as “HPV”)
  • Seasonal Influenza (such as “Flu”)
  • Measles, Mumps, Rubella, or any combination of Measles, Mumps, Rubella (such as “MMR,” “MR,” and “M” vaccines)
  • Meningooccal (MCV4, MPSV4, MenB-FHbp, MenB-4C)
  • Pneumoccal conjugate (PCV)
  • Polio (OPV, IPV)
  • Rotavirus (RV)
  • Varicella (VAR)
